Terms of Service

These Terms of Service ("Terms") govern your access to and use of energyclean.ca (the "Site"), operated by Energy Clean Home Services Inc. ("Energy Clean," "we," "us," or "our"), 595 Cityview Blvd Unit 9, Woodbridge, Ontario L4H 3M7, Canada. By accessing or using the Site, requesting a quote, or booking a service, you agree to these Terms. If you do not agree, please do not use the Site.

Our Services

Energy Clean provides residential heating, cooling, heat pump, ventilation, and indoor air quality services to homeowners in Woodbridge, Vaughan, Toronto, and the Greater Toronto Area. Information on the Site — including service descriptions, articles, guides, calculators, and estimating tools — is provided for general information only. It is not a binding quote, a warranty of results, or professional advice for your specific home. Final pricing, scope, and scheduling are confirmed in a written estimate or service agreement before work begins.

Quotes, Scheduling, and Communications

Submitting a form on the Site is a request for contact, not a completed booking. We will reach out by phone or email to confirm details, and where you have given express consent, by text message. Text message consent is described at the point of collection and in our Privacy Policy; message frequency varies, message and data rates may apply, and you can reply STOP at any time to opt out. Consent to receive texts is never a condition of purchase.

Rebates and Financing

References to rebates, incentive programs, and financing options are provided for convenience and reflect programs offered by governments, utilities, manufacturers, or third-party lenders. Program terms, eligibility, and availability change without notice and are determined solely by the program provider. Financing applications and any payments are processed by third parties on their own hosted systems under their own terms; we never collect payment card information on this Site.

Intellectual Property

The Site and all of its content — including text, graphics, logos, images, page designs, and software — are owned by Energy Clean or its licensors and are protected by Canadian and international copyright and trademark law. You may view, download, and print pages for your personal, non-commercial use. You may not reproduce, republish, distribute, scrape, or create derivative works from Site content without our prior written permission.

Acceptable Use

You agree not to misuse the Site. This includes not attempting to gain unauthorized access to any systems, not submitting false, misleading, or abusive form submissions, not interfering with the Site's operation or security features, and not using automated tools to harvest content or personal information from the Site.

Disclaimers

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Energy Clean disclaims all warranties, express or implied, regarding the Site, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Nothing in these Terms limits any warranty that is expressly stated in a signed service agreement, or any right you have under applicable consumer protection legislation, including the Ontario Consumer Protection Act, that cannot lawfully be waived.

Limitation of Liability

To the fullest extent permitted by law, Energy Clean and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or loss of use — arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of or related to the Site will not exceed one hundred Canadian dollars (CAD $100). Liability arising from services we perform at your home is governed by your written service agreement, not by this Site limitation. Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Energy Clean from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Site or your violation of these Terms.

Third-Party Links and Tools

The Site may link to third-party websites and services — such as rebate program pages, review platforms, financing providers, and social media. We do not control and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

Privacy

Your use of the Site is also governed by our Privacy Policy, which describes what we collect and how we use it, and by the Your Privacy Choices section, which explains your rights — including under PIPEDA, Quebec Law 25, and California law — and how to opt out of any sale or sharing of personal information (we do not sell personal information).

Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the courts located in the Province of Ontario, and you consent to the jurisdiction of those courts. Nothing in this section prevents either party from pursuing a claim in small claims court where eligible.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with the Privacy Policy, are the entire agreement between you and Energy Clean regarding use of the Site, and supersede any prior understandings about the Site. They do not replace or modify any signed service agreement covering work at your property.
